TRAQ BY ALEGRIA® APP PRIVACY POLICY
Please read this policy carefully as it governs the privacy of your personal data. For the definitions of the terms “TRAQ Services,” “we,” “our,” and “us,” please refer to the TRAQ Terms of Service.
Information We Collect
Information You Provide to Us
If you wish to create an account to use the TRAQ Services, you will be required to provide your first and last name, and you may, but are not required to, provide your gender, date of birth, height and weight. You may also choose to provide other types of information, such as a profile photograph, journal entries and a community username. If you contact us to participate in a survey, contest or promotion, we collect the information you submit such as your name, contact information and message.
Information from Third-Party Services
If you choose to connect your account on the TRAQ Services to your account on another service, we may receive information from the other service. For example, if you connect through Facebook or Instagram, we may receive information like your name, profile picture, age range, language, email address, and friend list. You can stop sharing the information from the other service with us by removing our access to that other service.
Information from Your Use of the TRAQ Services
The TRAQ Services collect data to estimate steps taken, distance traveled and calories burned. When your device syncs with our applications or software, data recorded on your device is transferred from your device to our servers.
Information on Your Use
When you access or use the TRAQ Services, we receive certain usage data regarding your interactions with the TRAQ Services; for example, when you install applications or software, create or log into your account, and pair your device to your account.
How We Use Information
We use collected information for the following purposes.
To Provide, Maintain & Develop TRAQ Services
We use collected information to deliver the TRAQ Services and to fulfill our obligations under the TRAQ Terms of Service. This includes providing you with statistical dashboard tracking of your estimated steps, distance traveled and calories burned, as well as certain trends in said data; to enable the community features of the TRAQ Services; and to provide customer support. We further use the information to troubleshoot and prevent errors; perform data analysis and testing; conduct surveys, contests and promotions; and develop new features for the TRAQ Services.
For the community features of the TRAQ Services, we may use your information to help you find and connect with other users and to allow other users to find and connect with you. For example, you can create a group name that is visible to other users to allow them to join your group. When another user has your group name, we show that user that you are a user of the TRAQ Services. Once joined to your group, another user can view your name, any profile photograph, and up to seven (7) days’ worth of your steps taken.
We may also personalize activity goals for you based on your historical activity data.
For Security
We use collected information to provide security for the TRAQ Services and users. For instance, we may use the collected information to authenticate users, protect against fraud and abuse, respond to a legal request or claim, conduct audits and enforce our Terms of Service and other policies.
How We Share Information
We do not share your personal information except in the following circumstances.
When You Agree to Share Your Information
When you create a group under the TRAQ Services’ community features, you agree to share certain information such as your name, profile photograph and up to seven (7) days’ worth of your steps taken. When you participate in surveys, contests, promotions or other challenges, information that you provide, such as your profile photograph, messages, steps taken, and other personal statistics, will be visible to other participants.
For Processing by Third Parties
We transfer information to our corporate affiliates, service providers, and other partners who process it for us, based on our instructions, and in compliance with this policy and any other appropriate confidentiality and security measures. These partners provide us with services globally, including for customer support, information technology, marketing, data analysis, research and surveys.
For Legal Reasons or to Prevent Harm
We may preserve or disclose information about you to comply with a law, regulation, legal process, or governmental request; to assert legal rights or defend against legal claims; or to prevent, detect, or investigate illegal activity, fraud, abuse, violations of our terms, or threats to the security of the TRAQ Services or the physical safety of any person. Our policy is to notify you of legal process seeking access to your information, such as search warrants, court orders, or subpoenas, unless we are prohibited by law from doing so. In cases where a court order specifies a non-disclosure period, we provide delayed notice after the expiration of the non-disclosure period. Exceptions to our notice policy include exigent or counterproductive circumstances, for example, when there is an emergency involving a danger of death or serious physical injury to a person.
If we are involved in a merger, acquisition, or sale of assets, we will continue to take measures to protect the confidentiality of personal information and give affected users notice before transferring any personal information to a new entity.
Data Retention
We keep your account information, like your name, email address, and password, for as long as your account is in existence because we need it to operate your account. We keep other information, like your activity data, because we use this data to provide you with your personal statistics and other aspects of the TRAQ Services. We also keep information about you and your use of the Services for as long as necessary for our legitimate business interests, for legal reasons, and to prevent harm.

Information Security

Your California Privacy Rights
As a California resident, you have certain rights, subject to legal limitations, regarding collection, use and sharing of your personal information.
Right to Opt-Out/Do Not Sell
You have the right to opt-out of sale of personal information. You are able to direct a business that sells personal information to stop selling that information.
Please note that we do not engage in the sale of any of your personal information collected by us.
Right to Delete
You have the right to request that we delete personal information about you that we have collected from you. This right is subject to exceptions that allow us to retain data; for example, to service a contract or for our internal business purposes. We will not delete data subject to an exception.

For any Request to Delete, in order to verify your identity, match you to our records, and to reduce fraud, we will ask you for your personal information or information about you. You will need to provide certain pieces of information. The information you provide must match our records for us to process your Request to Delete.
Right to Know
You have the right to know what personal information is collected, used, shared or sold about you. You can request either or both of the following types of reports:
For a Categories Report, you will need to provide certain pieces of information which must match our records for us to process your request. For a Specific Pieces Report, in order to verify your identity, match you to our records, and to reduce fraud, we will ask you for your personal information or information about you. You will need to provide certain pieces of information. The information you provide must match our records for us to process your request.
You can submit a request a Request to Delete by emailing us at legal@shoetron.com or by calling us at 1-833-763-2212, Monday through Friday, 8:30 a.m. to 5:00 p.m. PST. California consumers can submit a Request to Know twice in a 12-month period and the report will be provided free of charge.
Non-Discrimination
We will not discriminate against you for exercising your privacy rights as set forth above.
Household Request
If you are submitting a request on behalf of a household or another household member, we will need to verify each member of the household in the manner set forth above.
Timing of Response
We will strive to fulfill all requests above within 45 days from the date we receive your request. If additional time is needed to complete any request, we will notify you that additional time is needed, tell you the reason for the need for additional time, and tell you when you can expect your request to be completed.
Additional Information
We will maintain records of requests that are made that include the date of request, nature of request, manner in which the request was made, the date of our response, the nature of our response, and the basis for any denial of the request if it is denied in whole or in part.
Changes to This Policy
We will notify you prior to making any material changes to this policy and provide you with an opportunity to review the revised policy before deciding whether to continue using the TRAQ Services.
